Welcome to Second Gear. By accessing or using our task management and accountability service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

By using our service, you grant Second Gear a limited, non-exclusive, royalty-free license to:

• Share your User Content with other users as you direct (e.g., within groups you join)
• Make backup copies of your User Content for service reliability and security

This license exists solely to enable us to provide the service to you and ends when you delete your content or account.

You are solely responsible for your User Content. You represent that you have all necessary rights to the content you post and that your content does not violate any third-party rights.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Posting illegal, harmful, threatening, abusive, harassing, or offensive content
• Impersonating any person or entity, or falsely representing your affiliation
• Sending spam, unsolicited messages, or engaging in commercial solicitation
• Uploading viruses, malware, or any harmful code
• Attempting to gain unauthorized access to the service or other users' accounts
• Interfering with or disrupting the service or servers
• Scraping, crawling, or using automated means to access the service without permission
• Violating any applicable laws or regulations
• Harassing, bullying, or intimidating other users
• Using the service for any illegal or unauthorized purpose

6. Enforcement and Account Termination

We take violations of these terms seriously. If you violate these terms:

You may terminate your account at any time by deleting it through your account settings. Upon termination, your right to use the service immediately ceases.

7. Service Availability and Modifications

We strive to maintain high availability and reliability of Second Gear. However, we provide the service on an "as-is" and "as-available" basis without guarantees of uptime or uninterrupted access.

The service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical issues or server problems
• Events beyond our control (network outages, infrastructure failures, etc.)

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the service.

8. Pricing and Payment

Second Gear currently operates on a freemium model:

• Free Tier: Core features are available at no cost to all users.
• Premium Features: We may introduce paid premium features or subscription plans in the future. If we do, we will provide clear notice and pricing information.

If you choose to purchase premium features in the future, you agree to pay all applicable fees and charges. We reserve the right to change our pricing at any time with reasonable notice.

9. Data Export

Currently, Second Gear does not provide a built-in data export feature. We may add this functionality in the future.

If you wish to delete your account, you may do so at any time through your account settings. Upon deletion, your data will be permanently removed as described in our Privacy Policy.

10. Intellectual Property

The Second Gear service, including its design, features, graphics, software, and branding, is owned by Second Gear and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or reverse engineer any part of our service without our express written permission.

11. Disclaimer of Warranties

Second Gear is provided "as-is" and "as-available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties that defects will be corrected

We do not warrant that the service will meet your specific requirements or expectations. You use the service at your own risk.

Our total liability to you for any claim arising from your use of the service shall not exceed the amount you have paid us in the past 12 months (which may be zero if you are using the free tier).
